Florida's 14-Day PIP Rule: Why Seeing a Doctor Fast Protects Your Claim

Of all the deadlines that follow a Florida car accident, the 14-day PIP rule is the one that trips people up most — because it arrives while you are still sore, stressed, and dealing with a damaged car.

What is PIP, exactly?

Florida requires every driver to carry Personal Injury Protection (PIP) coverage of $10,000. Because Florida is a no-fault state, PIP pays regardless of who caused the crash. It generally covers 80% of reasonable and necessary medical expenses and 60% of lost wages, up to your policy limit.

The 14-day deadline

Under Florida Statute § 627.736, PIP benefits are only available if you receive initial services and care within 14 days after the crash. Qualifying initial care includes treatment from a medical doctor, osteopathic physician, dentist, chiropractor, or care received in a hospital or emergency department.

If you wait 15 days, your insurer can deny PIP benefits altogether — even if your injuries are real and clearly crash-related.

The 'emergency medical condition' distinction

There is a second layer many people never hear about: to access the full $10,000 in PIP benefits, a qualified medical provider must determine that you had an emergency medical condition (EMC). Without an EMC determination, PIP benefits are capped at $2,500. This is another reason prompt, well-documented medical care matters so much.

What if my bills exceed PIP?

Serious injuries blow past $10,000 quickly. When your injuries meet Florida's serious injury threshold — such as significant and permanent loss of an important bodily function, permanent injury, or significant scarring — you may step outside the no-fault system and pursue the at-fault driver for full damages, including pain and suffering.

Evaluating whether your case clears that threshold is exactly what an experienced car accident attorney does. CrashAid connects Florida crash victims with vetted attorneys for a free case review — no cost, no obligation.
