PIP exclusion and the upside
Florida’s PIP definition of a motor vehicle excludes motorcycles. That means no automatic no-fault medical pot for most riders. Health insurance, optional motorcycle medical benefits, and the other driver’s liability policy become the practical sources.
Because riders sit outside the no-fault system, they are generally not boxed in by the serious-injury threshold that car occupants must clear before pursuing pain and suffering from an at-fault driver.
Helmets and comparative fault
Under § 316.211, riders 21 and older may ride without a helmet if they carry at least $10,000 in medical benefits coverage. Riding lawfully without a helmet does not automatically end a claim, but insurers may argue injuries would have been less severe. Modified comparative negligence still applies — more than 50% fault can bar recovery.

Questions
Does my car’s PIP cover me on a motorcycle?
Generally no. Florida’s PIP definition of a motor vehicle excludes motorcycles, and a household car policy does not automatically replace that coverage for a rider.
I was not wearing a helmet. Can I still request a referral?
Yes. Section 316.211 sets when an adult rider may ride without a helmet. CrashAid is a free attorney referral service and will connect you with a participating attorney.
I was a passenger on the bike. Is this the right guide?
Yes. Say you were the passenger. Coverage questions are still different from a passenger-car crash.
How do I reach CrashAid after a motorcycle crash?
Call (941) 770-2727 or use the form. English and Spanish help is available, and the referral is free.
