Motorcycle Accidents in Florida: Why the Rules Are Different for Riders

Riders are often surprised to learn that the insurance rules they hear about for car accidents — PIP, the 14-day rule, the no-fault threshold — largely do not apply to them. That cuts both ways.

PIP does not cover motorcycles

Florida's Personal Injury Protection law defines 'motor vehicle' in a way that excludes motorcycles. That means a motorcyclist injured in a crash generally cannot draw on PIP benefits — there is no automatic $10,000 in no-fault medical coverage waiting for you, even if you carry PIP on a car you also own.

The practical takeaway: your health insurance, optional motorcycle medical coverage, and the at-fault driver's liability insurance become the main sources of recovery.

The upside: no 'serious injury' threshold

Because riders sit outside the no-fault system, they are not boxed in by it either. A car occupant generally must meet Florida's serious injury threshold before suing for pain and suffering. An injured motorcyclist can pursue the at-fault driver for full damages — including non-economic damages — without clearing that hurdle.

Helmets, and how they affect your claim

Under Florida Statute § 316.211, riders 21 and older may legally ride without a helmet if they carry at least $10,000 in medical benefits coverage. Riding lawfully without a helmet does not bar your claim — but expect the insurer to argue your injuries would have been less severe with one. Florida's comparative negligence rules let them try to shift a percentage of fault onto you, and above 50% you recover nothing.
